Trade dress becomes an effective tool in fighting against unfair competitors. The scope of its protection is broad: from design of a package to the interior of the cafe. However, since trade dress has been mentioned in the law, neither the antimonopoly nor court authorities have explained how to use it correctly.
How can a brand be protected by a trade dress?
To cover this acute question and other trade dress issues relevant for business, Lidings’ Intellectual Property practice experts Partner Boris Malakhov and Associate Anastasia Skovpen organized a special business breakfast for in-house lawyers. In addition to legislative issues the event’s program was also enriched by a presentation of a guest speaker, a stylist and fashion-columnist Anna Bashtovaya, talking about how color and shape affect people’s choice.
The event put together by Lidings jointly with Legal Insight Magazine took place on June 20th 2018 at Loft Ministerstvo in central Moscow, gathering 37 representatives of Russian and international companies.
In the course of the seminar Boris and Anastasia talked about the latest court and FAS practice discussing advantages and disadvantages in different approaches to protecting trade dress. The event was structured in a case-study format enabling participants to analyze real practical situations that legal departments of Russian and foreign companies encounter with and work out standard solutions.
