The Russian Government brought a draft law “On amendments to the Part IV o the Russian Civil Code” to the State Duma (link).
According to the draft law, it is suggested to invalidate art. 1478 of the Russian Civil Code and to amend art. 1477 of the Russian Civil Code to let individuals register a trademark in their names to individualize the goods or services.
Such amendments are focused on extending options for self-employed individuals to carry out activities. Moreover, such amendments would ensure equality of legal position between Russian and foreign citizens since some foreign legislations allow trademarks to be registered in the name of individuals without being registered as entrepreneurs.
Additionally, it is proposed to amend art. 1262 (5) of the Russian Civil Cide with a provision on compulsory state registration of the pledge of an exclusive right to a computer program or database registered with Rospatent.
The draft law aims to bring Russian legislation into line with the Treaty on the Eurasian Economic Union of 29 May 2014.
