Review Of Amendments to The Rules on Access to Information Contained in The State Information Monitoring System

On November 20, 2024, the Ministry of Industry and Trade prepared a draft of amendments to the rules for providing access to information contained in state information monitoring system, approved by Government Decree No. 1955 dated 31.12.2019 (the “Draft”).

Thus, the Office of the Prosecutor General of the Russian Federation, state extra-budgetary funds of the Russian Federation (“Extra-budgetary Funds”), the Ministry of Internal Affairs of the Russian Federation, the Ministry of Labor and Social Protection of the Russian Federation, the Pension and Social Insurance Fund are proposed to provide access using a personal account to a number of state information monitoring system data.

Access, as well as the amount of information to be provided, is proposed to be coordinated through the conclusion of an agreement on information interaction with the Advanced Technology Development Center and the Ministry of Industry and Trade on a free-of-charge basis.

The Office of the Prosecutor General of the Russian Federation and the Extra-budgetary Funds are proposed to provide access to such information as:

  • information on participants in the circulation of goods, on goods and their circulation;

  • aggregated (statistical) information on goods and their circulation;

  • information classified by the Government of the Russian Federation as publicly available.

The Prosecutor General Office is also proposed to provide access to state information monitoring system data in order to:

  • exercising supervision over the execution of laws, observance of human and civil rights and freedoms;

  • coordination of materials of control (supervision) measures sent by control (supervisory) authorities in relation to the activities of participants in the circulation of goods subject to mandatory marking with means of identification.

The Ministry of Internal Affairs of the Russian Federation is proposed to provide access to state information monitoring system data in order to:

  • development and adoption of measures to prevent crimes and administrative offenses related to the circulation of tobacco and nicotine-containing products without marking with means of identification;

  • generalization of law enforcement practice and analysis of the implementation of state policy in terms of prevention of crimes and administrative offenses related to the circulation of tobacco and nicotine-containing products without marking with means of identification;

The Ministry of Labor of the Russian Federation is invited to provide access to state information monitoring system data in order to:

  • realization of powers to implement state policy and normative-legal regulation in the sphere of providing disabled persons with technical rehabilitation equipment.

The Pension and Social Insurance Fund is proposed to provide access to state information monitoring system data in order to:

  • provision of state guarantees, social protection (support) measures, social services to certain categories of citizens, including within the framework of state social assistance.

The analysis of law enforcement practice shows the effectiveness of the information monitoring system as a tool for improving the effectiveness of state regulation and management in the relevant industries related to the production and circulation of goods subject to mandatory marking with means of identification, as well as the demand for state information monitoring system data on the part of federal executive authorities and other government agencies.

Thus, the changes are aimed both at increasing the transparency of information on the participants of the circulation and operations with relevant goods, and at strengthening control and supervision in the field of circulation of goods subject to mandatory marking with means of identification, detection and suppression of offenses in this area.
