The Supreme Court Сonfirmed the Jurisdiction of Russian Courts to Bankrupt a Foreign Debtor

Starting from 2021 bankruptcy of foreign legal entities in Russian commercial courts has been actively developing. Most of the judgments were issued by courts of appeal and cassation stages and then confirmed by “refusal” rulings of the Supreme Court. It is also interesting that such bankruptcy proceedings were initiated by either Russian state bodies or Russian legal entities.

In its recent review of judicial practice on employment cases by Russian courts2, the Supreme Court of the Russian Federation (the Supreme Court) defined legal strategies that should be guided when considering disputes related to the termination of an employment contract at the employer’s initiative. The Supreme Court of the Russian Federation clarified specifics of employment by individuals and small and medium-sized businesses

On 29 May 2018, the Supreme Court of the Russian Federation issued the Decree of the Plenum N 15 where clarified issues concerning regulation of labor relations with employers — individuals both with and without sole proprietors’ status, as well as with employers — small business entity. The Decree clarifies provisions of Chapter 48 and Chapter 48.1 of the Labor Code of the Russian Federation dedicated to issues regarding regulation of labor between the abovementioned parties.
